Welcome to Elates. By accessing or using our app, you agree to the following Terms of Use. Please read them carefully.

1. Acceptance of Terms By downloading, accessing, or using Elates, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use the app.

2. The Elates Service Elates is a mobile application offering guided Pilates video classes and workout sessions designed to support your fitness practice at home or on the go. The service provides: a library of guided Pilates video classes for various levels and goals, personalized class recommendations, progress tracking and personal workout history, and AI-generated content such as class descriptions, recommendations, and workout summaries.

Certain features and content within Elates are generated or assisted by artificial intelligence. AI-generated content is provided for informational and motivational purposes only and may not always be accurate, complete, or appropriate for every user.

3. Health Disclaimer & User Responsibility Elates is a fitness app and does not provide medical advice, diagnosis, or treatment. The content provided is for general informational and educational purposes only. Before starting any exercise program, including Pilates, you should consult with a qualified healthcare professional, especially if you are pregnant, recovering from injury, have a medical condition, or have any concerns about your physical fitness.

You acknowledge that participating in physical exercise carries inherent risks, including the risk of injury. You assume full responsibility for your use of the app, your physical condition, and any consequences resulting from your participation in the activities suggested by Elates. Stop exercising immediately if you experience pain, dizziness, or discomfort, and seek medical attention if needed.

4. User Accounts You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and keep it up to date. You must be at least 16 years old, or the minimum age of digital consent in your country, to create an account.

5. Free Trial, Premium Subscriptions & Billing Elates may offer a free trial period to new users, allowing access to premium features for a limited time. Unless canceled before the end of the trial, your subscription will automatically convert to a paid subscription at the applicable rate.

Premium features are billed through the Apple App Store or Google Play Store. Payments, cancellations, and refunds are managed exclusively by those platforms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings.

We reserve the right to modify pricing, trial conditions, or subscription features with advance notice.

6. Acceptable Use You agree not to: use the app for any unlawful, harmful, or fraudulent purpose; share, redistribute, or publicly broadcast Elates video content outside the app; attempt to reverse-engineer, decompile, or disrupt the app or its AI systems; automate access to the service without prior written authorization; circumvent paywalls, trial limitations, or subscription mechanisms; or misrepresent the nature of the service or its AI-generated content.

7. Intellectual Property All software, video content, branding, logos, designs, and AI systems within Elates are the exclusive property of Arctics Group or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app and access its content for personal, non-commercial purposes only. Recording, downloading, redistributing, or reproducing video content is strictly prohibited without prior written authorization.

8. AI-Generated Content Some text, recommendations, and personalized suggestions within Elates are produced by artificial intelligence systems. While we strive to ensure quality and relevance, AI-generated content may contain inaccuracies or be unsuitable for your specific situation. You should not rely on AI-generated content as professional fitness, medical, or health advice.

9. Limitation of Liability Elates is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Arctics Group shall not be liable for: injuries, health issues, or physical consequences resulting from the use of the app or participation in the exercises; decisions made based on AI-generated content; any direct or indirect damages resulting from the use or inability to use the app; loss of data, business interruption, or reputational harm; or errors, omissions, or misinterpretations in the content or recommendations provided.

You are responsible for exercising safely and within your physical capabilities.

10. Termination We may suspend or terminate your access to Elates if you violate these Terms or misuse the service. You may stop using the app and delete your account at any time through the in-app settings.

11. Governing Law These Terms are governed by the laws of France, where Arctics Group is registered, without regard to conflict of law principles.

12. Changes to Terms We may update these Terms at any time. If significant changes are made, we will notify you within the app. Continued use of Elates after updates constitutes acceptance of the revised Terms.
